Legal, Collections and Eviction Services
Legal and collections providers include law firms and collection agencies that handle evictions, lease violations, unpaid balances and guarantor claims. They work within state landlord-tenant law and federal and state debt collection rules.

Why this matters
Student housing collections often involve parent guarantors, roommates on separate leases and residents who leave town at the end of the semester. A legal or collections partner who understands that setup helps you recover balances and handle lease violations while following your state's rules on notices, fees and fair debt collection.
When you need it
- After move-out, when unpaid rent and damage balances need to be recovered.
- When a resident or guarantor stops paying and notices or filings are needed.
- When a lease violation escalates beyond what your team can resolve.
- When updating lease and guarantor documents before a new leasing season.
Common challenges in student housing
- Pursuing balances from residents and guarantors who have left the state.
- Splitting shared damage among roommates on separate leases.
- Keeping up with notice, fee and eviction rules that vary by state and locality.
- Documentation gaps from the property that weaken a claim.
- Protecting your reputation on campus while still collecting what is owed.
What to look for
- Experience with by-the-bed leases and guarantor agreements, including how they pursue balances owed by guarantors in another state.
- Clear knowledge of your state's notice requirements and eviction process, and how they keep up with changes.
- Collections practices that follow federal and state debt collection rules, with written policies you can review.
- Reporting that shows each account's status so you can answer owner and resident questions.
- A fee structure in writing, whether flat fee per case, contingency on collections or hourly.
- Guidance on what your on-site team should document before an account is handed off.
- A respectful approach to residents and parents, since collections conduct can affect your reputation on campus.
How pricing usually works
- Evictions are often a flat fee per case, with court costs passed through.
- Collections are commonly charged on contingency as a share of what is recovered.
- Lease reviews and general advice may be billed hourly or as a flat project fee.
- Some providers have minimum account volumes or charge for skip tracing and filing extra.
How prices are usually structured, not what they cost. Actual prices vary by market, property and scope, so compare written proposals.
Questions to ask a supplier
- Have you handled collections from parent guarantors, including those in other states?
- How do you stay current with notice and eviction rules in our state?
- How is your fee structured for evictions and for collections?
- What documents do you need from us before taking on an account?
- How will we see the status of each account?
- How do you communicate with residents and parents during collections?
- Are your collection practices written down, and can we review them?
